Law's senior lecturer writing and presenting

New Te Piringa - Faculty of Law Senior Lecturer Dr Alberto Alvarez-Jimenez has recently been published in the Journal of International Economic Law. It’s a prestigious peer-reviewed publication, and his article is entitled “The Great Recession and the New Frontiers of International Investment Law: The Economics of Early Warning Models and the Law of Necessity”.
The article focuses on one of the main tools to avoid economic collapses - early warning models (EWMs) “which have received increasing attention by the European Central Bank, the IMF, and the Fed, and on how international investment law should deal with the use of EWMs by States", says Dr Alvarez-Jimenez.
In particular, the article deals with the question of what happens in international legal terms when a state, which relies on EWMs to adopt measures aimed at preventing a crisis, adversely affects foreign investors. “I also discuss the level of deference that investor/state tribunals may accord to states relying on EWMs when taking economic preventive action and illustrate how international arbitration tribunals should deal with debates on the quality of the given EWMs,” Dr Alvarez-Jimenez says.
He holds a Doctor of Laws degree from the University of Ottawa law, an LLM from McGill University. Prior to joining Te Piringa - Faculty of Law, he lectured at the University of Ottawa in Canada and at several Latin-American law schools.
His research agenda concentrates on public international law, international trade law, and foreign investment law and he has published extensively in international journals. In December Dr Alvarez-Jimenez is heading to New York to present a paper at a workshop organised by the International Organizations Interest Group of the American Society of International Law to be held at Columbia University Law School. The paper is titled “From Al-Qaeda to ISIL: The Decisions and Practices of the UN Security Council Related to the Right to Self-Defense Against Non-State Actors from 2001 - 2014: A Deafening Silence After Resolutions 1368 and 1373 (2001)”.
“The timing of this research project is significant given the ongoing military operation against ISIL in Iraq and Syria,” says Dr Alvarez-Jimenez.
