Te Piringa - Faculty of Law, the CNZSU and CEREL present this public lecture by Associate Professor Shaun Fluker from the University of Calgary.
Public participation has been a component of resources and environmental project decision-making for decades. In recent years legislative amendments in Canada have significantly restricted the right to participate in resources and environmental project decision-making. In this presentation, Professor Fluker will provide an overview of these changes in Canada and give some comparative context from which to consider the 2013 amendments made to the Exclusive Economic Zone and Continental Shelf (Environmental Effects) Act 2012 and associated regulations which came into force in February 2014 and allow for non-notified activities including offshore petroleum exploration in New Zealand.
Shaun Fluker is an Associate Professor of Law with the University of Calgary in Canada and is currently in New Zealand as an academic visitor with the Te Piringa Faculty of Law at the University of Waikato until June 2014. Shaun's research generally concerns the following subject areas: (1) access to the legal system for persons who advocate for environmental protection; (2) the implementation of environmental norms in law; (3) the regulation of environmental markets. Shaun has published several articles on legal rules concerning the protection of ecological integrity in Canada's national parks. He is also a regular contributor to www.ablawg.ca - a law blog which provides academic commentary on legal developments in Canada. His most recent publication is a co-authored piece entitled "Who Regulates Trading in the Carbon Market?" is forthcoming in the Journal of Environmental Law & Practice. Shaun teaches courses in administrative law, environmental law, endangered species law, statutory interpretation, legal theory, and he operates the law school's energy and environmental law clinic.
